A guardian ad litem is an attorney that is typically ordered by the Court to represent the best interests of a child. The guardian ad litem will interview the parties, the witnesses each party feels is important, as well as the children. Additionally, the guardian ad litem is permitted to inspect documents, that may otherwise be hearsay, school records, medical records and any other evidence the guardian ad litem feels is important. After completing his or her investigation, a guardian ad litem will typically issue a report. The report can be several pages long and will clearly detail each of the facts investigated, how each fact is relevant, information offered by each witness, as well as the guardian ad litem’s recommendations for how to resolve this matter. Typically, the guardian ad litem’s report will outline a detailed schedule for visitation, how legal custody should be handled, whether or not visitation should be supervised as well as any other issue particular to the parties. A guardian ad litem is generally a good idea for complex cases with highly contested custody issues. A court may also recommend a guardian ad litem to reduce the time needed for a final hearing or to assist the parties in obtaining a settlement.
