CHILD SUPPORT

In January 2007, Georgia Child Support laws changed.  Prior to 2007, a non-custodial parent simply paid a straight percentage of his or her gross income.  A Non-Custodial Parent’s obligation to pay child support is now based on both parties’ incomes.   The Georgia legislature created a child support calculator that is used for calculating all child support obligations.  The child support calculator considers the parties’ incomes to determine a base amount of child support.  The calculator then adds up the costs of the children’s health insurance premiums, day care costs, private school tuition, tutoring expenses, extra-curricular expenses and other similar expenses and divides these expenses pro-rata according to each party’s income.

When creating the child support calculator, the legislature attempted to streamline the calculation of child support and include more expenses relating to raising children.  The child support worksheet allows two W-2 employees to plug in their incomes and the expenses related to the children and quickly determine the non-custodial parent’s child support obligation.  The worksheet also allows for upward and downward deviations from the calculated child support for Non-Custodial parents that earn more or less than a pre-determined amount.  Unfortunately, the child support worksheet did not resolve every aspect of determining support, but the Millard Law Firm can help you with the difficulties in determining the gross income for a business owner or other person in control of their own income, but it has resolved many other concerns both parents had in the calculation of child support.  Whether you are paying child support or receiving child support, the Millard Law Firm can help you pay or receive a fair amount.  You can find a downloadable child support worksheet at cscal.gaaoc.us.  If you have any questions about child support in Georgia, please call the Millard Law Firm to schedule a free consultation with an attorney.
